RENTAL AGREEMENT
This Rental Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into as of {check_in_date}, for the rental term beginning {check_in_time} on {check_in_date} and ending {check_out_time} on {check_out_date} (the “Rental Term”), by and between {guest_first_name} {guest_surname} (the “Guest”) and the undersigned Property Host (the “Host”). Guest agrees to rent Surfing Turtle Gulf Shores, located at 458 E Beach Blvd Gulf Shores AL (the “Property”), for the duration of the Rental Term.
OCCUPANCY
Guest agrees that no more than {number_of_guests} persons approved and confirmed in the booking reservation shall be permitted on the Property at any time during the Rental Term. This limitation includes all overnight occupants and any day visitors. All occupants must comply with the terms and conditions of this Agreement.
CONDITION AND USE OF PROPERTY
The Property is provided in “as is” condition. Host shall make reasonable efforts to maintain the Property, but does not guarantee uninterrupted operation of utilities, appliances, internet, or amenities. Failure of any infrastructure or amenity shall not entitle Guest to any refund or rate reduction, as set forth in the policies below.
Guest acknowledges that use of amenities such as pools, decks, stairs, and similar features involves inherent risks, particularly for children, and agrees to assume all responsibility for such use.
Guest agrees to use the Property solely for residential purposes, to maintain it in a clean and sanitary condition, and to avoid any damage or misuse. Guest and all occupants shall not disturb neighbors or engage in unlawful, offensive, or disruptive behavior.
HOUSE RULES AND ENFORCEMENT
Guest must be at least twenty-seven (27) years of age to book. All occupants must be listed on the reservation. No third-party bookings are permitted. The booking Guest must remain on the Property for the entire stay.
Strict occupancy limits apply and include all day visitors.
No parties, events, or gatherings are permitted without prior written approval from Host.
Outdoor security cameras may be in use. Tampering with, disabling, or obstructing any security device is strictly prohibited and will result in immediate removal without refund and may result in additional charges.
No pets are permitted in or on the Property.
No smoking or vaping is permitted in or on the Property.
If any undisclosed guests, animals, or violations of house rules occur without prior approval, Guest may be required to vacate the Property immediately without refund. Guest agrees that removal may be enforced by local law enforcement if necessary.
Violations of occupancy limits, unauthorized events, smoking policies, or other house rules may result in additional charges, immediate termination of the reservation without refund, and removal from the Property.
SAND, BEACH, AND PROPERTY CARE RULES
Guest agrees to keep all sand outside of the Property. All sand must be removed prior to entry. Sand and seashells shall not be rinsed in sinks, tubs, drains, or washing machines. Items must be cleaned outdoors prior to laundering.
Only designated beach items may be taken from the Property and must be returned clean. Items may not be left unattended.
POOL RULES
No diving.
No glass permitted in the pool area.
No surfboards, boogie boards, skimboards, or similar equipment permitted in the pool.
The pool gate cannot be propped open and must remain closed at all times.
TRASH AND MAINTENANCE
All trash must be placed in designated bins located at the Property. Guest is responsible for ensuring bins are accessible for scheduled service. If access is blocked, Guest assumes responsibility for handling trash placement.
DAMAGE AND CHARGE AUTHORIZATION
Guest agrees to be responsible for any damage to the Property beyond normal wear and tear. Guest authorizes Host to charge the payment method on file for damages, excessive cleaning, rule violations, unauthorized guests, smoking violations, or any additional costs incurred during or after the stay.
DEFAULT AND REMOVAL
If Guest fails to comply with the conditions of this Agreement, Guest shall vacate the Property immediately upon request, remove all belongings, and leave the Property in good condition. No refund shall be issued. Guest agrees to reimburse Host for any damages, legal costs, or enforcement expenses, including those associated with removal.
ASSIGNMENT OR SUBLEASE
Guest shall not assign this Agreement, sublease the Property, or permit use of the Property by any persons not included in the reservation or exceeding permitted occupancy.
RISK OF LOSS AND INDEMNIFICATION
Guest assumes all risk for personal property brought onto the Property. Host shall not be liable for any loss, theft, or damage.
Guest agrees to indemnify and hold harmless Host and all associated parties from any claims, damages, liabilities, or expenses, including attorney’s fees, arising from Guest’s use of the Property or any injury, damage, or loss occurring during the Rental Term.
RELEASE OF LIABILITY
Guest waives and releases any claims against Host and associated parties for any injury, loss, or damage occurring on or near the Property and assumes all risks associated with occupancy and use.
ENTRY AND INSPECTION
Host reserves the right to enter the Property at reasonable times with notice for inspection, maintenance, or other necessary purposes. In emergencies, entry may occur without notice.
UNAVAILABILITY OF PROPERTY
If the Property becomes completely unavailable or legally inaccessible prior to check-in due to a verified natural disaster, severe property damage, or government-mandated island closure, no refunds or credits will be issued by the Host. Host shall have no financial or legal liability to the Guest. Guests must rely strictly on their independent travel insurance policy to recover any booking losses, accommodation costs, or associated fees.
CANCELLATION, WEATHER, AND HURRICANE POLICIES
CANCELLATION POLICY BY CHANNEL: Guest explicitly agrees that cancellation timelines, deadlines, and refund eligibilities are strictly dictated by the booking channel used:
– Airbnb & Vrbo Bookings: Cancellations are strictly governed by the specific cancellation policy selected and displayed on the respective platform at the time of booking.
– Direct Website Bookings: All direct cancellations must be requested in writing. Reservations cancelled 60 days or more prior to the scheduled arrival date will receive a refund of their deposit, minus any non-refundable fees. Cancellations made 59 days or fewer prior to the scheduled arrival date are strictly 100% non-refundable.
GUEST ASSUMPTION OF RISK & TRAVEL INSURANCE ADVISORY: The Property maintains a strict zero-refund policy under any and all circumstances within the non-refundable window. Because the Host will not issue refunds or credits for any reason whatsoever (including but not limited to weather, evacuations, utility outages, or personal emergencies), Guests are explicitly advised and strongly encouraged to purchase independent “Cancel For Any Reason” (CFAR) Travel Insurance to protect their vacation investment. By signing this agreement, Guest acknowledges that they assume all financial risk of trip disruption or cancellation if they choose to decline travel insurance.
NON-REFUNDABLE PROCESSING FEES: Credit card processing fees (exactly 3%) charged by our merchant account payment processor (Stripe) are completely non-refundable to the Guest under any and all circumstances, including all cancellations, booking errors, or property unavailability.
AGREEMENT SIGNATURE DEADLINE: This rental agreement must be digitally signed, and a valid government-issued ID submitted, within 24 hours of completing the booking. Failure to return the signed agreement and ID within this 24-hour window constitutes a violation of booking policies and will result in the immediate cancellation of the reservation, and the 3% credit card processing fee will not be refunded.
GOVERNING LAW
This Agreement shall be governed by the laws of the State of Alabama.
ATTORNEY’S FEES
In any action arising out of or related to this Agreement, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs.
GENERAL PROVISIONS
This Agreement constitutes the entire agreement between the parties. Any modifications must be in writing and signed by both parties. Failure to enforce any provision shall not constitute a waiver. If any provision is deemed invalid, the remainder shall remain enforceable. Electronic signatures shall be deemed valid and binding.
ACKNOWLEDGMENT
By completing a reservation, Guest acknowledges that they have read, understood, and agree to this Agreement and the Terms of Service, which are incorporated herein by reference.
